Justice Vimla Singh Kapoor, Order on Board by Justice Manindra Mohan Shrivastava J. 23. 11. 2020 Heard.

In view of certification by the Additional Sessions Judge, Khairagarh, the office objection is overruled. Heard on IA 1/2020, application for condonation of delay in filing the application for leave to appeal. Upon due consideration, delay in filing the application for grant of leave to appeal is condoned and the IA No. 1/2020 stands allowed. As regards grant of leave to appeal, after hearing learned State counsel, we find that learned trial Court has acquitted all the accused persons even though they have been specifically named in FIR and specific role has been assigned to them by the injured witnesses. We further find that acquittal of the accused/ respondents of the charge of commission of murder of Kheduram has also been granted by the Court below despite the fact that there are eye witnesses to this effect. In this view of the matter this Court finds it to be a fit case to grant leave to appeal to the State, and accordingly it is hereby granted as such.

Let the appeal filed by the State be registered as Criminal Appeal and on that being done the summons be issued to the accused/respondents informing them about the date of listing of the case to be fixed by the Office. CRMP is accordingly allowed. Sd/- Sd/- (Manindra Mohan Shrivastava) (Vimla Singh Kapoor) Judge Judge Ajay
