IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No. 10379 of 2025 Golekha Behera @ Budhia … Petitioner Mr. D. Mitra, Advocate -versus- State of Odisha … Opposite Party Mr. M. R. Patra, Addl. PP CORAM: JUSTICE G. SATAPATHY ORDER(ORAL) 23. 12. 2025 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S. 483 of the BNSS by the petitioner for grant of bail in connection with Madhupatna PS Case No. 217 of 2023 corresponding to Spl. GR Case No. 105 of 2023 pending in the Court of learned Adhoc Addl. District Judge (FTSC), Cuttack for commission of offences punishable U/Ss. 341/ 323/ 354/294/509 of IPC r/w Section 12 of the POCSO Act. 3. Heard, Mr. Debashis Mitra, learned counsel for the petitioner and Mr. M. R. Patra, learned Additional Public Prosecutor in the matter and perused the record. None appears for the victim despite being informed as apprised by the learned Addl. Public Prosecutor. 4.

Admittedly, this is a bail jump case and the petitioner was arrested on 29. 07. 2025 for the NBWA issued against him on 28. 05. 2025. In the meantime, he must have felt the rigor of law by remaining in custody for flouting the orders of the Court. In that view of the matter and taking a lenient view, this Court without expressing any view on merits admits the petitioner to bail. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.

50,000/- (Rupees Fifty Thousand) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following conditions:- (i) The petitioner shall cooperate in the trial by attending the Court on each date of posting unless his attendance is dispensed with by the learned trial Court and (ii) In case the petitioner fails without sufficient cause to appear in the Court in accordance with the terms of the bail, the learned trial Court may proceed against the Petitioner for offence U/S. 269 of BNS, 2023 in accordance with law. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. (G.
