Nimmi Mishra, aged about 33 years, wife of Gopal Krishna Jha @ Deepak Jha, resident of Krishnapur, Near Teneja House, Manaitand, P. O. & P. S. Dhansar, District–Dhanbad, Permanent Address – Bhuli B Block 394, Aam Bagan, P. O. Bhuli, P. S. Bankmore, District – Dhanbad (Jharkhand) …. …. Opposite Parties ---- CORAM: HON’BLE MR. JUSTICE RAJESH KUMAR ---- For the Petitioner : Mr. Sandip Kr. Burnwal, Adv. For the State : Mrs. Priya Shrestha, A. P. P. ----th 03/Dated: 19 December, 2024 1. Heard the parties. 2. The present criminal revision application has been filed against the order dated 01. 04.

2024, passed by the learned Principal Judge, Family Court, Dhanbad in Original Maintenance Case No. 339 of 2021, whereby maintenance of Rs. 5000/- per month has been awarded in favour of the Opposite Party No. 2. 3. It has been submitted by the learned counsel for the revisionist that the O. P No. 2-wife is the earning member and she is capable of maintaining herself and as such, maintenance of Rs. 5,000/- per month is nothing but against the jurisprudence of Section 125 of the Cr. P. C It has also been submitted that the revisionist/husband was running Coaching Institute and he has suffered due to pandemic of Covid-19 and as such, his income has been missed. 4. Having heard learned counsel for the parties and from perusal of the impugned order, it appears that the above argument of the revisionist has been well considered by the Family Court. The Family Court has taken into consideration the evidence brought on record, the income aspect of the O. P No.

2/wife has also been considered and thereafter, maintenance of Rs. 5,000/- per month has been awarded. 5. I find no reason to interfere with the impugned order passed by the learned Family Court. Accordingly, the present criminal revision application is hereby, dismissed. (Rajesh Kumar, J. ) Raja/-Uploaded
