IN THE HIGH COURT OF GUJARAT AT AHMEDABAD R/SPECIAL CIVIL APPLICATION NO. 13308 of 2020 ========================================================== SHRI PARAMHANS SUKHANANDJI SEVA TRUST Versus STATE OF GUJARAT ========================================================== Appearance: MS. KRUTI M SHAH(2428) for the Petitioner(s) No. 1 MR TRUPESH KATHIRIYA AGP for the Respondent(s) No. 1 NOTICE SERVED(4) for the Respondent(s) No. 1,2,3 ========================================================== CORAM: HONOURABLE MR. JUSTICE A. C. RAO Date : 21/12/2020 ORAL ORDER Heard learned advocates for the respective parties. 2. It is the case of the petitioner that initially the Collector, Rajpipla had rejected the lease in question. The said order was challenged by the petitioner before the Government and by order dated 23. 6. 2018, the respondent Collector was directed to collect the lease for sand in favour of the petitioner.

However, the Assistant Geologist has written a letter to the Sarpanch of Nandol Gram Panchayat again asking for the opinion as to whether the lease should be given or not. 3. It appears that instead of obeying the order passed by the superior appellate authority, the Collector has again asked for the no objection from the Panchayat. It appears to be without jurisdiction and he has not obeyed the order of the superior authority. 4. Under the circumstances, the said communication dated 4. 3. 2020 is quashed and set aside. The respondents are directed to execute the lease-deed in favour of the petitioner as per the order passed by the Government on 23. 6. 2018 within period of 1 month from the date of receipt of this order. 5. With above observations and directions, present petition stands disposed of. (A. C. RAO, J) MAYA S. CHAUHAN/beena/dolly
