Modhusudhon Singh, aged about 58 years, S/o (L) M. Hemchandra Singh of Khangabok Awang Leikai, PO & PS Thoubal, Thoubal District, Manipur & 7 Ors. …Petitioners - Versus- The State of Manipur represented by the Principal Secretary/Commissioner/Secretary, Education(S), Government of Manipur, Office at Secretariat, Babupara, PO & PS Imphal, Imphal West District, Manipur-795001 & 3 Ors. …Respondents BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA O R D E R 02. 09. 2024. [1] Heard Mr. M. Hemchandra learned senior counsel for the petitioners, Mrs. CH. Sundari learned G. A on behalf of the State respondents and Mr. RK. Deepak learned senior counsel on behalf of MPSC.
[2] The short issue in this petition is about non-stipulation of time frame for notifying Recruitment Rules for Physical Education Teacher in compliance of the order dated 08. 02. 2023 passed by this Court in WP(C)No. 115 of 2023. [3] As directed in the above mentioned order, it is stated that framing of the Recruitment Rules for Primary Physical Education Teachers, Undergraduate (PET), Graduate (P. E. T) Lecturer is being processed and being taken as per procedures. [4] The petitioners are aggrieved by the above order for not stipulating time frame. It is submitted that some of the petitioners and other eligible candidates are retiring shortly and the State respondents may be directed to notify rules within stipulated period of time. [5] Mrs. CH. Sundari learned GA submits that the Joint Secretary Education (s) Government of Manipur vide its letter dated 22. 05. 2024 directed the Director of Education (s) to forward draft rule to MPSC for its view and a reminder dated 22. 07.
2024 was also sent in this regard. [6] Mr. RK. Deepak learned senior counsel for MPSC submits that draft Rule is not provided to the MPSC by the State authority. [7] This Court is of the opinion that writ petition may be disposed of at this stage by issuing innocuous order to the State respondent to furnish draft copy of Rules to the MPSC within two weeks and the MPSC shall give its view to the draft proposal within a further period of one month from the date of receipt of necessary papers from the State respondents. [8] It is made clear that this Court does not express any opinion on the merit of the case. [9] With the above observations, writ petition is disposed of. [10] Furnish a copy of this order to the learned counsel appearing for the parties. JUDGE John Kom
