IN THE HIGH COURT OF ORISSA AT CUTTACK W. P. (C). No. 31344 of 2024 Bidyutlata Mohapatra …. Petitioner Mr. R. K. Bisoi, Advocate -versus- State of Odisha & Others …. Opp. Parties Mr. P. P. Behera, ASC CORAM: THE HON’BLE MR. JUSTICE CHITTARANJAN DASH ORDER Order No. 13. 12. 2024 01. 1. Heard learned counsel for Petitioner and the State. 2. By means of this application, the Petitioner prays for the following relief:- “to quash the order dtd. 9. 12. 2024 under Annexure-6 in respect of posting of Opp. Party No. 3 in the place of petitioner at Balasore and direct the Opp. Party No. l to allow the petitioner to continue at Balasore till her retirement i. e 31. 10. 2025 within a time stipulation as fixed by this Hon'ble Court. And/or issue any other appropriate writ/ writs, order/orders, direction/directions as deem fit and proper in the fitness of the case. ” 3.

It is contended by learned counsel for the Petitioner that the Petitioner will be retiring very shortly within a period of one year. Having regard to the notification under Annexure-4 an employee on the verge of retirement is accommodated in the manner as stipulated therein. In the case of the present Petitioner, however, the same has not been followed, for which she moves a representation before the authority. 4. In view of the submissions as above, if any such representation is pending before the Secretary to Government, ST & SC Development Minority & Backward Classes Welfare Department, Odisha i. e. Opposite Party No. 1, the same be considered in line with the resolution under Annexure-4 and be disposed of sympathetically within a period of one month from the date of production of the certified copy of this order and shall communicate the result of the representation to the Petitioner within a period of two weeks thereafter.

It is made clear that this Court has not expressed any opinion on the merit of the case. The Writ Petition is accordingly disposed of. In the circumstances, the Petitioner may not be disturbed from the present place of posting till the disposal of the representation.
