Neutral Citation No. ( 2026:JHHC:13524 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI Criminal Revision No. 388 of 2026 --- Dilip Besra represented through his natural guardian cum father namely, Mantri Besra … … Petitioner Versus The State of Jharkhand … … Opposite parties --- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioner : Mr. Gautam Kumar, Advocate For the Opposite party : A. P. P. --- 2/06. 05. 2026 Heard Mr. Gautam Kumar, learned counsel appearing for the petitioner and the learned A. P. P. appearing for the State. This application is directed against the judgment dated 05. 02. 2026 passed in Criminal Appeal No. 3 of 2026 by the learned Additional Sessions Judge I, Pakur whereby and whereunder the order dated 04. 12. 2025 passed in M. C. A No. 2008 of 2025 arising out of Amrapara P. S. Case No. 63 of 2025 by the learned Principal Magistrate, Juvenile Justice Board, Pakur rejecting the prayer for bail of the petitioner has been affirmed.
Submission has been advanced by the learned counsel for the petitioner that at the time of the alleged incident, the petitioner was less than 13 years of age. It has further been submitted that only a suspicion has been created that on account of the petitioner staying with the victim in the same house for 3 days, the victim had committed suicide and the responsibility has been affixed on the petitioner. Learned counsel for the petitioner further adds that the petitioner is in observation home since 11. 11. 2025. Learned A. P. P. for the State has opposed the prayer for bail of the petitioner. It appears from the allegation that the dead body of the sister-in-law of the informant was found near a river and it is said that she had committed suicide by consuming poison.
So far as the allegation against -2-the petitioner is concerned, he is said to have abated the commission of suicide by the sister-in-law of the informant and the foundation for such allegation seems to be the fact that the petitioner and the deceased had stayed together under the same roof for a period of 3 days prior to the incident. Considering the aforesaid facts, including the age of the petitioner and the fact that he is in observation home since 11. 11. 2025, while setting aside the orders dated 05. 02. 2026 and 04. 12. 2025, direct that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Principal Magistrate, Juvenile Justice Board, Pakur in connection with Amrapara P. S. Case No.
63 of 2025, subject to the condition that one of the bailors should be the father of the petitioner who shall ensure the safety of the petitioner and shall further ensure that he is kept away from the anti-social elements. This criminal revision is allowed. (Rongon Mukhopadhyay, J) th 6 May 2026 R. Shekhar Cp 3 Uploaded 08. 05. 2026
