Upon coming of this petition for consideration today, counsel for the respondents along with the Investigating Officer-Mr. Roop Krishan has produced the CD file pertaining to the FIR No. 0038/2021 dated 27. 01. 2021 registered with Police Station, Rajouri. 2. According to the Investigating Officer, the offences covered in the impugned FIR, upon investigation conducted in the matter, as also having regard to the statement of the complainant/respondent 2 herein under Section 164 Cr. P. C.
recorded during the course of investigation, did not establish any case against the petitioners herein, as a consequence whereof, names of the petitioners herein came to be deleted as accused persons from the FIR in question. 2 CRM(M) No. 105/2021 CrlM No. 339/2021 3. Upon perusal of the CD file, the aforesaid statement of the Investigating Officer gets authenticated. 4. Under these circumstances, nothing survives for adjudication in the instant petition. Accordingly, instant petition along with the connected application shall stand disposed of. 5. Interim direction, if any, shall stand vacated. 6.
