THIS PETITION, COMING ON FOR DISMISSAL, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE H. P. SANDESH - 2 - CRL. RP No. 595 of 2024 ORAL ORDER This Court vide order dated 06. 02. 2025 observed that today, the counsel for the petitioner was absent and this Court, vide order dated 09. 05. 2024, suspended the sentence directing the petitioner to pay 50% of the fine amount, including the amount already deposited before the Trial Court. Though this order was passed on 09. 05. 2024 and notice also ordered, till date PF is not paid to issue notice against the respondent and hence, order dated 09. 05. 2024 was recalled and the respondent was given liberty to proceed against the petitioner in accordance with law and also given a week’s time to furnish PF and also made it clear that if PF is not paid within a week, the petition will be dismissed on the next date of hearing.
Inspite of the said order, today, the counsel for the petitioner is absent and not paid PF to issue notice against the respondent. Accordingly, the petition is dismissed for non-prosecution in view of the order dated 06. 02. 2025. Sd/- (H. P. SANDESH) JUDGE SN
