Sudhansu Kumar Deo, Advocate : M/s. Shahid Yunus, Advocate For the State : M/s. Shiv Shankar Kumar, A. P. P : M/s. Ruby Pandey, A. P. P --- 05/03. 12. 2024 Heard the Parties. Both these bail applications arise out of same police case. Accordingly, they are being disposed of by a common order. Petitioners have been made an accused in connection with Deoghar Cyber P. S. Case No.

68/2024, registered under Sections 419/420/467/468/471/120(B) of the Indian Penal Code, Sections 66(B)/ 66(C)/ 66(D)/ 84 (C) of the I. T. Act, pending in the Court of learned Additional Sessions Judge-II-Cum-Spl. Judge Cyber Crime, Deoghar. On 26. 06. 2024, Deoghar town police, on the basis of confidential information raided a place near railway line at Kasya and apprehended these petitioners along with co-accused persons. It is alleged that two mobile phones and SIM cards were recovered from the possession of petitioner Hatim Ansari and three mobile phones were recovered from the possession of petitioner Sarfaraz Ansari. Learned A. P. Ps have opposed the prayer for bail and submitted that the victims have reported that the mobile phone which was recovered from the possession of the petitioners were used in cheating them. Learned lawyer for the petitioners submitted that co-accused Sakur Ansari has been granted by this court vide B. A. No.

7373 of 2024 and one victim has also alleged that he has also cheated him and the case of the petitioners stand on similar footing. Learned A. P. P. submitted that at the time of hearing of the bail application of Sakur Ansari, case diary was available for perusal and the case was still under the stage of investigation and from the perusal of the up-to date case diary which was received at that time, statement of none of the victims were recorded and on these grounds co-accused Sakur Ansari was granted bail. Regard being had to the facts and circumstance of the case and considering the fact that victims have stated that both these petitioners were involved in cheating them; I am not inclined to enlarge the petitioners on bail. Accordingly, their prayer for bail is hereby rejected. The petitioners, if so advised may renew their prayer for bail after three months. (Ambuj Nath, J. ) Saurabh uploaded
