Item No. 2 (Through video conferencing) IN THE HIGH COURT OF MANIPUR AT IMPHAL WP(C) No. 723 of 2019 Md. Mujibur Rahman …. Petitioner/s - Versus – Union of India & 4 Ors. .... Respondent/s BEFORE HON’BLE MR. JUSTICE AHANTHEM BIMOL SINGH 28. 09. 2020 Heard Mr. M. Devananda, learned counsel appearing for the petitioner and Mr. W. Darakishwor, learned Sr. PCCG appearing for the respondents. When the matter is taken up, the counsel for the petitioner fairly submitted that his grievances raised in this writ petition is against the decision of the authorities for not allowing the petitioner to enjoy extension of 1(one) year tenure posting in his present place of posting provided under the Standing Order No. 07/2015. The learned counsel further submitted that by virtue of the interim order dated 09. 09.

2019 passed in the present writ petition, the petitioner has already enjoyed his tenure posting in his present place of posting for more than 1(one) year and accordingly, nothing remains to be decided in the present writ petition. However, the counsel for the petitioner submitted that in view of the grave situation arising out of the Pandemic Covid-19, he may be allowed to remain posted in his present place of posting till the end of December, 2020. WP(C) No. 723 of 2019 Page 1 The prayer made by the petitioner cannot be granted by this Hon’ble Court for simple reason that this Court has no authority to issue such direction for his continued posting up to December, 2020 unless it is provided under the transfer policy framed by the competent authorities. However, liberty is given to the petitioner to approach the concerned authorities by making representation in this regard and if such representation is made by the petitioner, the authorities may decide the same on its own merit.

In view of the above observations and directions, the present writ petition is disposed of. Earlier interim order stands vacated. JUDGE Lhaineichong Digitally signed Yumk by Yumkham Rother Date: ham 2020. 09. 28 13:14:46 Rother +05'30' WP(C) No. 723 of 2019 Page 2
