No. 8828 of 2017 2024:KER:59550 P. V. KUNHIKRISHNAN, J. -------------------------------- Crl. M. C. No. 8828 of 2017 ---------------------------------th Dated this the 06 day of August, 2024 O R D E R This Criminal Miscellaneous Case is filed to quash the proceedings in C. C. No. 311/2016 on the file of Judicial First Class Magistrate Court, Kakkanad, arising from Crime No. 1138/2014 of Thrikkakara Police Station. The above case is charge sheeted against the petitioner and another alleging offences punishable under Section 498A r/w 34 of IPC. st 2.

The prosecution case is that the 1 rd accused, husband, harassed the 3 respondent/defacto complainant, both physically and mentally, demanding the ATM card and Credit Crl. M. C. No. 8828 of 2017 2024:KER:59550 Card and on the instigation of the petitioner/2nd st accused, the 1 accused physically and mentally rd harassed the 3 respondent/defacto complainant to rd transfer 82 cents of property belonging to the 3 respondent to the petitioner/2nd accused. Hence, it is alleged that the accused committed the offence. According to the petitioner, even if the entire allegations are accepted, no offence is made out nd against the petitioner who is the 2 accused. 3. Heard the learned counsel appearing for the petitioner and the learned Public Prosecutor. 4. The counsel for the petitioner submitted that, even if the entire allegations are accepted, no offence is made out against the petitioner who is the nd 2 accused.

The learned Public Prosecutor and the rd learned counsel for the 3 respondent takes me through Annexure-A1 complaint which leads to the Crl. M. C. No. 8828 of 2017 2024:KER:59550 registration of the case. The Public Prosecutor takes me through some paragraphs of Annexure-A1 complaint and submitted that, there are specific allegations against the petitioner regarding the theft of certain articles. It is true that, in Annexure-A1 complaint, the offences alleged are under Sections 498A, 379 r/w 34 of IPC. But, in the final report, as evident by Annexure-A3, the Police deleted Section 379 IPC and the offence alleged are only under Section 498A r/w 34 IPC. A perusal of Annexure-A3 final report would show that, the only allegation nd against the petitioner who is the 2 accused is that, st on her instigation, the 1 accused physically and mentally harass the defacto complainant to transfer rd 82 cents of property belongs to the 3 respondent to the petitioner.

It will be better to extract the final report of the Police: Crl. M. C. No.

No. 8828 of 2017 2024:KER:59550 st allegation is that the petitioner instigated the 1 st accused and thereafter the 1 accused harassed the defacto complainant to transfer the property in the name of the petitioner. Even if these allegations are accepted, there is absolutely nothing to show that nd the petitioner who is the 2 accused had done anything to attract Section 498A IPC. All the st allegations are against the 1 accused. Therefore, I am of the considered opinion that the continuation nd of prosecution against the petitioner who is the 2 accused is unnecessary. But, I make it clear that, I st have not considered the case of the 1 accused and the court concerned will consider the same separately, untrammeled by any observation in this order. Therefore, this Criminal Miscellaneous Case is allowed. All further proceedings against the Crl. M. C. No.
