(1 of 2) [CRLW-448/2020] HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JODHPUR D. B. Criminal Writ Petition No. 448/2020 Varju, W/o Ramaram, By Cat Jat, R/o Pokrasar Police Thana Chohtan, District Barmer. (At Present Lodged At Open Air Camp, Barmer). ----Petitioner Versus 1. State, Through Secretary, Home Dept. , Jaipur. 2. Collector, Barmer. 3. Superintendent, Central Jail, Barmer. ----Respondents For Petitioner(s) : By post For Respondent(s) : Mr. Farzand Ali, G. A. -cum-A. A. G. HON'BLE MR. JUSTICE SANDEEP MEHTA HON'BLE MR. JUSTICE RAMESHWAR VYAS Order 26/11/2020 The convict petitioner has been granted regular parole of forty days by the District Parole Committee, Barmer vide order dated 24. 08. 2020 passed in furtherance of the recommendations drawn in its meeting dated 18. 08. 2020, whereby she has been directed to furnish a personal bond in the sum of Rs. 50,000/- and two sureties in the sum of Rs. 25,000/- each as a pre-requisite condition for being released on parole.
She has forwarded this writ petition from jail praying for relaxation in the condition of furnishing surety bonds in terms of the order of the District Parole Committee. Learned A. A. G. alongwith the reply has annexed a report of the SHO, Police Station Chohatan, District (2 of 2) [CRLW-448/2020] Barmer verifying the fact that the financial position of the family of the convict prisoner is normal. It is also stated in the reply that the convict petitioner has satisfactorily availed the facility of first and second parole by furnishing personal bonds. In this background and having regard to the fact that on earlier occasions too, the convict petitioner was released on parole upon furnishing personal bond only, we deem it proper to release the petitioner on regular parole of 40 days by relaxing the condition of furnishing two surety bonds as imposed by the District Parole Committee vide order dated 24. 08. 2020. The said requirement is waived.
The other conditions of the order are maintained. The writ petition is allowed, accordingly. (RAMESHWAR VYAS),J (SANDEEP MEHTA),J 14-Pramod/-
