IN THE HIGH COURT OF MANIPUR : AT IMPHAL W. P. (C) No. 522 of 2020 N. Rita Devi …Petitioner -Versus- State of Manipur & 2 ors. ... Respondents B E F O R E HON’BLE MR. JUSTICE KH. NOBIN SINGH 07. 10. 2020 Heard Mr. D. Julius Riamei, learned counsel appearing for the petitioner. [1] By the instant writ petition, the petitioner has prayed for issuing a writ of mandamus or any other appropriate writ to direct the respondents to consider the case of the petitioner for promotion as Coach (Hockey) on in-charge basis. [2] According to the petitioner, she is a National Hockey player and had represented the State Hockey Team in various tournaments/championships as player. She passed NIS, a diploma in Hockey and is also a graduate. [3] A recruitment process was held for recruitment of 11 (eleven) posts of the Physical Education Teachers (PET) in the Directorate of Youth Affairs and Sports, Government of Manipur from 13. 10. 1999 to 19. 10. 1999.
The petitioner participated in the said recruitment process. While awaiting the result of the said recruitment process, a ban on direct recruitment was imposed by the Government of Manipur at that point of time and as such the final results of the said recruitment process could not be declared. The petitioner approached the Hon’ble Gauhati High Court, Imphal Bench by way of filing W. P. (C) No. 627 of 2003, questioning the cancellation order dated 14. 02. 2003, which was disposed of on 13. 03. 2006 quashing it. [4] Thereafter, the petitioner approached the authority concerned and ultimately, she was given appointment to the post of Physical Education Teacher vide an order dated 04. 03. 2019 after about 20(twenty) years and since then the petitioner has been serving in that capacity. [5] There are about 36 vacant posts of Coaches in different disciplines including 5 posts of Hockey Coach.
As per the Recruitment Rules for the post of Coach, the method of recruitment is 50% by promotion from amongst PETs of the Department and 50% by Direct Recruitment. The petitioner submitted a representation dated 30. 01. 2020 on the basis of which the Government has made communication on 13. 02. 2020 for examining the matter and furnishing comments/views. No action appears to have been taken in the matter and on the contrary, it has come to the notice of the petitioner that an advertisement dated 07. 09. 2020 has been made for engaging Hockey Coach on Contract basis. Being aggrieved by the inaction on the part of the respondents, the present writ petition has been filed by the petitioner.
[6] When the matter is taken up for consideration, it has been submitted by the learned counsel for the petitioner that the instant writ petition can be disposed off by issuing an innocuous order and accordingly, writ petition stands disposed of with the direction that the respondents shall consider the representation dated 30. 01. 2020 submitted by the petitioner and dispose of the same within a month from the date of receipt of a copy of this order by issuing a speaking order in respect thereof. Copies of this order shall be sent to the learned counsels appearing for the parties through their WhatsApp/e-mail.
