HIGH COURT OF UTTARAKHAND AT NAINITAL Anticipatory Bail Application No. 304 of 2024 Anees ... Applicant Versus State of Uttarakhand ... Respondent Present:- Mr. Mohd. Safdar, Advocate for the applicant. Ms. Manisha Rana Singh, AGA for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant seeks anticipatory bail in Case Crime No. 17 of 2024, under Section 380 IPC, Police Station Jhabrera, District Haridwar. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the applicant would submit that there is no evidence against the applicant; merely, based on the statement of the co-accused, he has been implicated. 4. Learned State Counsel would submit that non bailable warrants had already been issued against the applicant prior to his filing anticipatory bail application in this Court. While considering the anticipatory bail, the nature of offence and other circumstances are important factors but the conduct of an accused is also much relevant. 5.
In the instant case, the anticipatory bail application filed on 03. 04. 2024. The Investigating Officer has filed affidavit to the effect that in order to arrest the applicant, raid was made several times, but he managed to escape. Thereafter, non bailable warrants have issued against him on 18. 03. 2024 and he is still absconding. 6. Having considered, this Court does not see reason to grant anticipatory bail to the applicant. Accordingly, the anticipatory bail application deserves to be rejected. 7. The anticipatory bail application is rejected. (Ravindra Maithani, J. ) 09. 07. 2024 Ravi
