For the reasons enumerated in application, same is allowed. Accompanying additional submissions by way of affidavit of complainant alongwith documents Annexures A-1 to A-4 are taken on record, subject to all just exceptions. Main case 1.

Petitioner Angraz Singh has filed petition under Section 438 of Cr. P. C. for grant of anticipatory bail in case FIR No. 23 dated 13. 04. 2024 CRM-M-23209-2024 (O&M) -2-under Section 406, 498-A of IPC registered at Police Station Women Police Station, Chandigarh. 2. As per the facts of case, Yakshita Arora filed written complaint against her husband Angraz Singh and other members of in-laws family. As per the facts, parties came in contact with each other through Instagram in 2019 and with consent of both the families, their marriage was settled. Roka ceremony was performed in Nada Sahib Gurudwara and they had spent Rs. 38,000/-. Marriage was performed on 16. 01. 2022 in Hotel Piccadily, Sector-22, Chandigarh, according to Sikh rituals. Her father had spent Rs. 10 to 12 lakhs on marriage. After marriage, she came to her matrimonial home in Bareta, District Mansa, Punjab. She was told to live in a house which was still under construction.

In the said house, there were no household articles. She was told to bring articles from her parents. All her jewellery, shagun etc. was handed over to her in-laws. When she demanded back her jewellery from her mother-in-law, she was told that same was lying with Harwinder Kaur-maternal aunt. She was taunted and ill-treated in matrimonial home. There was demand for cash of Rs. 5 lakhs and furniture etc. Members of her in-laws family were given gold ornaments, even then she was taunted and harassed for bringing less dowry. She noticed that her husband was addicted to intoxicants and he was having a pistol in his cupboard. Her husband left the house and did not return home for two days. She has narrated various incidents when she was insulted and beaten up in the matrimonial home. There were frequent quarrels in family. All gold ornaments given by her parents were misappropriated. There was demand for huge money. On the day of Rakhi CRM-M-23209-2024 (O&M) -3-festival on 30. 08.

2023, her husband brought her to parental house. He quarreled with her and left with her parents. With these allegations, matter was inquired and present FIR has been registered. 3. Learned counsel for petitioner argued that petitioner was granted interim bail vide order dated 09. 05. 2024. He has already joined investigation. All dowry articles given at the time of marriage are already recovered. To support his arguments, learned counsel for petitioner has annexed undertaking of father of complainant (Annexure P-2) dated 03. 09. 2023 vide which dowry articles were received back by complainant and her father. Without proper appreciation of the facts, anticipatory bail filed by petitioner was wrongly declined by learned Additional Sessions Judge, Chandigarh vide order dated 29. 04. 2024. Petitioner is ready to join investigation as and when required. 4. Bail petition is opposed by learned counsel representing complainant.

During arguments, it is conceded that some of the dowry articles have been returned but even now gold ornaments belonging to complainant are yet to be recovered. Learned counsel for complainant further pointed out that petitioner is having unauthorized Arms and he is extending threats. Said Arms are yet to be recovered. Learned counsel for complainant also referred to subsequent complaint filed by DGP, Police Headquarter, Sector-9, Chandigarh (Annexure A-4), where during mediation proceedings heated arguments took place and threats were extended by present petitioner. Therefore, in the light of aforesaid factual position, petitioner is not entitled to be released on anticipatory bail. CRM-M-23209-2024 (O&M) -4- 5. Bail petition is also opposed by learned counsel representation U. T. Chandigarh. Registration of FIR is matter of record. It is pointed out that during the course of inquiry, recovered dowry articles were handed over to respondent No. 2 on 03. 09.

2023 and undertaking was duly signed by complainant as well as her father Rajesh Arora. Said receipt/undertaking is Annexure R-1. In pursuance of interim order dated 09. 05. 2024, petitioner joined investigation on 14. 05. 2024 and 06. 01. 2025. It is pointed out that as per the list of dowry articles produced by complainant (Annexure R-2), other gold ornaments are yet to be recovered. Therefore, anticipatory bail petition is also opposed by learned counsel representing U. T. Chandigarh. 6. I have considered the arguments and have gone through the record carefully. Contents of FIR indicates that complainant and present petitioner Angraz Singh got married in 2022. She lived in matrimonial home in Bareta, District Mansa. Thereafter, on account of dispute complainant came back to her parental house on 30. 08. 2023. On the basis of complaint, matter was inquired and finally present FIR has been registered. As per status report filed by learned counsel representing U. T.

Chandigarh, during inquiry proceedings dowry articles detailed in undertaking (Annexure R-1) were recovered and handed over to Rajesh Arora-father and Yakshita Arora-complainant on 03. 09. 2023. There is another undertaking dated 03. 09. 2023 where again Rajesh Arora returned some silver jewellery belonging to the child given by in-laws and further confirmed that one gold set, one gold ring and one silver jhanjar were outstanding towards their side. There is another undertaking given by Gamdoor Singh dated 03. 09. 2023 vide which marriage gifts received from CRM-M-23209-2024 (O&M) -5- Rajesh Arora at the time of marriage of his son Angraz Singh were returned and he also confirmed receipt of articles mentioned in page No. 2 i. e. silver ornaments mentioned in undertaking. Aforesaid documents clearly indicate that both families had returned articles to each other as referred in undertaking.

Now, at this stage, learned counsel for complainant argued that gold ornaments belonging to complainant are yet to be recovered. Purchase of said gold ornaments, entrustment to petitioner and its alleged misappropriation is matter of trial. Undertaking dated 03. 09. 2023 will be looked into during the course of trial. Learned counsel representing U. T. Chandigarh also confirmed that during investigation, it was found that petitioner is not in possession of any licensed weapon. In the light of aforesaid factual position, no purpose would be served by sending petitioner behind the bars. 7. Therefore, anticipatory bail petition filed by petitioner is allowed and interim bail already granted in his favour vide order dated 09. 05. 2024 stands confirmed, subject to the terms and conditions as detailed under Section 438(2) of Cr. P. C. 8. Pending application(s), if any, also stands disposed of accordingly. 09. 07.
