IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 7153 of 2024 ----- Md. Sahjad @ Md. Sahjad Kuraisi, S/o Seraj Kuraishi, R/o Village-Bind Mohalla, Sahadat Chowk, Chatra, P. O. & P. S. - Chatra, District-Chatra. .......... Petitioner. -Versus- The State of Jharkhand .......... Opp. Party. ----- CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Sushant Kumar Sinha, Advocate Mr. Kumar Udayan, Advocate For the State : Mr. Prabir Kr. Chatterjee, Spl. P. P. ----- Order No. 06 Date: 03. 12. 2024 1. The petitioner apprehending his arrest in connection with Chatra Sadar P. S. Case No. 233 of 2024 registered under Section 317(1) of the Bharatiya Nyaya Sanhita, 2023, Section 11 of Prevention of Cruelty to Animals Act, 1960 and Sections 5/12 of the Jharkhand Bovine Animal (Prohibition of Slaughter) Act, 2005, has prayed for grant of anticipatory bail. 2.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F. I. R. There is alleged recovery of 70 kg. of bovine meat from the shop of the petitioner. In fact, the place from which there is alleged recovery of bovine meat does not belong to the petitioner. He is not involved in slaughtering and trade of bovine animals. On perusal of the written report, it would itself be evident that he has been implicated in this case merely on hearsay statements. Otherwise also, seizure list prepared in this regard does not bear signature of any independent witness. Co-accused Md. Afsar has already been granted anticipatory th bail by this Court vide order dated 28 October, 2024 passed in A. B. A. No. 6980 of 2024. The petitioner has no criminal antecedent as has been stated in paragraph no. 13 of the present anticipatory bail application.

He, however, undertakes to co-operate in the ongoing investigation. Hence, he may be given the privilege of anticipatory bail. 3. Learned Spl. P. P. opposes the petitioner’s prayer for grant of anticipatory bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail. 5. Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chatra in connection with Chatra Sadar P. S. Case No. 233 of 2024 subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Rajesh Shankar, J. ) Vikas/ -2- A. B. A. No. 7153 of 2024
