Bhattacharjee, GA. Mr. P. Saha, Advocate. HON’BLE THE CHIEF JUSTICE MR. AKIL KURESHI Order 10/01/2020. Petitioner seeks reevaluation of his answers by an independent body. The petitioner had appeared in final examination of Higher Secondary (H. S. +2 Stage) examination th conducted by the School Board on 8 of March, 2018. The results were declared in May, 2018. Petitioner was not satisfied with the marks assigned to him in various subjects in particular, he had expected higher marks in Chemistry, Biology and Mathematics papers. As per Rules, he applied for rechecking which was granted. According to the petitioner, during rechecking he found that his answer sheets were not properly evaluated. The request of the petitioner cannot be granted.
Rechecking or reassessment of the answer sheets of a student can only be done as per the Rules framed by the examining body. The petitioner was granted rechecking of his papers and to the extent errors were noticed, the same were corrected and supplementary mark sheet issued. There is no rule pointed out to me which would permit even internal reevaluation by the School Board itself. The request of the petitioner is one step away. The answer sheets are evaluated by an independent body which simply cannot be ordered. Petition is dismissed. (AKIL KURESHI), CJ sima
