JUSTICE PUNEET GUPTA, JUDGE ORDER 26. 12. 2024 Mr. Amit Gupta, learned counsel appearing for the respondent has presented in the open Court an application on behalf of the respondent seeking withdrawal of O. A No. 116/JK/2000 which was disposed of by the Central Administrative Tribunal, Chandigarh vide judgment dated 13. 09. 2007. He further submits that the judgment passed by the Tribunal dated 13. 09. 2007 was though not stayed by this Court yet the same was not implemented by the petitioner and as a result the respondent has been continuing in the State of J&K. It is submitted that the respondent is not interested now to go to the Haryana cadre.
This is exactly what has been submitted by the respondent in the application. The application presented in the open Court is taken on record. 2 SWP No. 218/2011 In view of the application and statement made by the learned counsel on instructions from the respondent, the respondent is permitted to withdraw O. A. No. 116/JK/2000. The aforesaid petition filed by the respondent is allowed. The judgment passed by the Tribunal is set aside and the O. A. No. 116/JK/2000 is dismissed as withdrawn.
