AKIL KURESHI Order 25/11/2020 The petitioner was enjoying a Touji granted by Agartala Municipal Corporation (AMC) from where he was running his business since long time. The AMC desired to vacate the petitioner and other similar Touji holders of the area for development of the region. With the intervention of the Court, the petitioner was offered another shop admeasuring 524. 14 sq. ft. in the same locality which the petitioner has also accepted. However, the petitioner’s grievance arose since the AMC issued a notice of demolition dated 21. 08. 2020. AMC has appeared and taken a stand that the demolition notice was thereafter withdrawn.
Counsel for the AMC clarified that there is no threat of eviction or demolition against the petitioner at the new site. He, however, clarified that the premises which the petitioner was previously occupying would be demolished for development of the area to which the petitioner obviously cannot have any objection, now that he has been resettled at a place which he has also accepted. In due course, AMC would also execute a fresh Touji in favour of the petitioner at the new site. Needless to add, the petitioner would have no claim over the premises possession of which was enjoyed by the petitioner previously. Petition is disposed of accordingly. (AKIL KURESHI), CJ Pulak
