(Oral) The applicant is in judicial custody in FIR/Case Crime No. 202 of 2024, dated 28. 07. 2024, under Sections 109, 3(5) of Bharatiya Nyaya Sanhita, 2023, Police Station Transit Camp, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, on 27. 07. 2024 at about 09:30 PM, the co-accused along with two associates entered into the house of the informant and stabbed his daughter. 4. State was given time to file objections, but objections have not been filed. 5.
Learned counsel for the applicant would submit that the applicant is not named in the FIR; he has not stabbed the victim; it was the co-accused, who stabbed the victim. 6. Learned State counsel admits that the main role of stabbing is assigned to the co-accused. 7. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
