Adhin Saw @ Ramadhin Saw, S/o Bhulas Saw All R/o Village-Pipra, PO & PS-Chauparan, District-Hazaribagh ... … Petitioners Versus The State of Jharkhand ... … Opposite Party CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioners : Mr. Lalan Kumar Singh, Advocate For the State : Mr. Shree Prakash Jha, A. P. P ----- 04/17. 12. 2024 The petitioners apprehending their arrest for the offences punishable under Sections 341/323/307/379/504/506/34 of the Indian Penal Code, have prayed for grant of anticipatory bail. 2. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the F. I. R. There is case and counter case between the parties for the same occurrence.
The petitioners have been roped in the present case by the informant due to land dispute. Though there is specific allegation against the petitioner no. 2 – Raushan Saw @ Raushan Kumar that he assaulted the informant on his head by means of rod, however, the injuries sustained by him have been found simple in nature. Hence, no case under Section 307 I. P. C is made out. So far as the petitioner nos. 1 and 3 are concerned, there is general and omnibus allegation against them. The petitioners have no criminal antecedent as has been stated in paragraph no. 6 of the present application. They, however, undertake to co-operate in the ongoing investigation. Hence, they may be given the privilege of anticipatory bail. 3. Learned A. P. P opposes the petitioners’ prayer for anticipatory bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioners on anticipatory bail.
Accordingly, the petitioners above named, in the event of their arrest/surrender within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of st learned Judicial Magistrate, 1 Class, Hazaribagh, in connection with Chauparan P.
