This matter is taken up through Hybrid Arrangement (Virtual/ Physical Mode). 2. Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel appearing for the State-Opposite Party. 3. The present application has been filed by the Petitioner seeking pre-arrest bail in connection with Khandagiri P. S. Case No. 842 of 2024, corresponding to C. T. Case No. 2224 of 2024, pending in the court of learned J. M. F. C. -V (Cog. Taking), Bhubaneswar, for alleged commission of offences punishable under Sections 115(2)/271/296/351(2) of B. N. S. of 2023. 4. On perusal of the record, it appears that the offences alleged in the F. I. R.
are all bailable in nature. Page 1 of 2. 5. Learned counsel for the Petitioner submitted that subsequently offence under Section 351(2) of B. N. S. , 2023 has been added. 6. On careful consideration, it is found that offence under Section 351(2) of B. N. S. , 2023 is also a bailable offence. 7. In such view of the matter, this Court is of the view that there is no apprehension of arrest. 8. As such, the anticipatory bail application is not maintainable. 9. Accordingly, the ABLAPL is disposed of with the observation made hereinabove.
