IN. 5 SHOUGRAKPAM Digitally signed by SHOUGRAKPAM DEVANANDA DEVANANDA SINGH Date: 2024. 12. 20 14:47:59 +05'30' SINGH IN THE HIGH COURT OF MANIPUR AT IMPHAL WP(C) No. 875 of 2024 K. Heera Kabui … Petitioner Vs. State of Manipur & ors. … Respondents B E F O R E HON’BLE MR. JUSTICE AHANTHEM BIMOL SINGH O R D E R 20-12-2024 Heard Mr. I. Lalitkumar, learned senior counsel assisted by Ms. Karuna, learned counsel appearing for the petitioner and Mrs. R. K. Emily, learned Deputy GA appearing for the respondents. In view of the limited prayer made on behalf of the petitioner and as agreed to by both the counsel appearing for the parties, the present writ petition is being disposed of at the Motion stage itself.

At the outset, the learned senior counsel appearing for the petitioner submitted that the petitioner will be satisfied for the time being if the present writ petition is disposed of by passing an innocuous order by directing the Commissioner (TA & Hills), Government of Manipur, to consider the representation dated 05-12-2024 submitted by the petitioner on its own merit and strictly in terms of the applicable guidelines and to dispose of the same by issuing a speaking order within a stipulated period. Mrs. R. K. Emily, learned Deputy GA appearing for the respondents fairly submitted that as the prayer made on behalf of the petitioner is confined to the consideration and disposal of the representation submitted by the petitioner, she has no objection in WP(C) No. 875 of 2024 Contd…/- -2- disposing of the present writ petition as prayed for by the counsel appearing for the petitioner.

Taking into consideration the submission advanced by the counsel appearing for the parties, this court is of the considered view that interests of justice will be met if the present writ petition is disposed of with the following directions:- (i) The Commissioner (TA & Hills), Government of Manipur, is hereby directed to consider the aforesaid representation dated 05-12-2024 on its own merit and strictly in terms of the applicable guidelines and to dispose of the same by issuing a speaking order; & (ii) It is made clear that the whole process should be completed as early as possible. With the aforesaid directions, the present writ petition is disposed of. JUDGE Devananda WP(C) No. 875 of 2024 Contd…/-
