Instant petition has been filed in the year 2011 wherein and whereby the petitioner has prayed for following reliefs:- (i) Writ of certiorari, quashing the order passed by the District Panchayat Election Officer/Deputy Commissioner, Poonch vide No. DCP/PA6508-13 dated 03. 06. 2011 which is illegal, arbitrary, against the facts, discriminatory and passed with malafide intention. And may also quashing certificate/letter of authentication as elected Panch in favour of the respondent No. 10 and may also quashing the status of the respondent no. 10 as Panch of Ward No. 8 in Upper Panchayat Shindra and may also quashing the inquiry conducted by the Assistant Commissioner (Revenue) Poonch.
(ii) Writ of mandamus commanding the official respondents to declare the petitioner as elected Panch in Ward No. 8 of Panchayat Upper Shindra and may further commanding the respondents to produce the record of the votes polled in favour of the petitioner along with record of counter files of ballet papers. And may also commanding the respondents to conduct re-election in ward No. 8 of Panchayat Upper Shindra and also conduct the counting of earlier polled votes. With further prayer 2 OWP No. 862/2011 commanding the SSP, Poonch and SHO Police Station, Poonch to register FIR against the Presiding Officer, Returning Officer, Assistant Commissioner (Rev) Poonch for cheating and may directing them further to submit the status of investigation before this Hon’ble Court. 2. The reliefs prayed for in this petition by afflux of time have become redundant and as a corollary, this petition has become infructuous.
