IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No. 604 of 2026 Manoj Kumar Bajpayee … Petitioner Mr. A. Tripathy, Advocate -versus- State of Orissa … Opposite Party Mr. P. Satpathy, Addl. PP CORAM: JUSTICE G. SATAPATHY ORDER(ORAL):09. 04. 2026 1. This is a bail application U/S. 483 of BNSS by the petitioner for grant of bail in connection with Gaisilat PS Case No. 25 of 2025 corresponding to Special GR Case No. 08 of 2025 pending in the file of learned Additional Sessions Judge, Padampur, for commission of offences punishable U/Ss. 276/277/ 111(2)(b) of BNS r/w Sections 21(b)/25 of NDPS Act, on the main allegation of transporting 40 bottles of 100ml WINCEREX Cough Syrup and 155nos. of Pentazocine Lactate Injections. 2. Heard, Mr. Amitav Tripathy, learned counsel for the petitioner and Mr. P. Satpathy, learned Additional Public Prosecutor in the matter and perused the record including the copy of depositions of PWs. 1 to 7. 3.

Admittedly, the petitioner is renewing his prayer for bail purportedly under the changed circumstance of examination of some witnesses, but the petitioner is in custody since 14. 02. 2025, however, the learned Addl. PP seriously opposes the bail application of the petitioner for having criminal antecedents, but mere existence of criminal antecedent without the assurance of right to speedy trial to an accused cannot be considered to be an impediment to refuse bail to the accused and in this case, although 7 out of 14 charge-sheeted witnesses having already been examined have not substantially supported the prosecution allegation against the petitioner. In such view of the matter and taking into account the pre trial detention of the petitioner in custody, but there being no embargo of Section 37 of NDPS Act, since the petitioner being found to have been facing trial for offence U/S. 21(b) of NDPS Act, this Court without expressing any view on merits admits the petitioner to bail. 4.

Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty-five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 5. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference. (G.
