2025:HHC:36004 IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No. 16843 of 2025 Decided on: 29. 10. 2025 Rajinder Singh … Petitioner Versus State of Himachal Pradesh and another … Respondents Coram Hon’ble Mr. Justice Ajay Mohan Goel, Judge. 1 Whether approved for reporting? _____________________________________________________ For the petitioner : Mrs. Suman Thakur, Advocate. For the respondents : Mr. Pushpender Jaswal, Addl. AG. Ajay Mohan Goel, Judge (Oral) Notice. Mr. Pushpender Jaswal, learned Additional Advocate General, accepts notice on behalf of the respondents. 2. By way of this writ petition, the petitioner has inter alia prayed for the following reliefs:- “A) that the respondents may kindly be directed to allow the commencement of cultural festival to be organized up to 12 A. M. from 1. 11. 2025 to 4. 11. 2025. ” 3.
The prayer of the petitioner is that the cultural activities, which are to be organized on the occasion of holding of Renukaji fair be ordered to be held up to 12:00 a. m. from 01. 11. 2025 to 04. 11. 2025 so that it gives an opportunity to all the Artists to perform. Presently, the timing has been fixed up to 10:00 p. m. only. 1 Whether reporters of the local papers may be allowed to see the judgment? 2025:HHC:36004 4. This Court is of the considered view that fixation of the timing for holding cultural festival is the domain of the local administration and it is not for the High Court under Article 226 of the Constitution of India to start passing administrative orders qua holding of such like functions. Otherwise also, this Court has very serious doubt as to whether any direction can be passed to the effect that the timing of the cultural activities be extended from 10:00 p. m. , because, obviously, holding of any such function beyond 10:00 p. m.
may create nuisance as far as the residents of nearby areas, including elderly people and children are concerned. Therefore, no such direction can be passed. However, as prayed for, the petitioner is granted liberty to approach the Authorities in this regard. The petition stands disposed of in above terms, so also pending miscellaneous application(s), if any. (Ajay Mohan Goel) Judge October 29, 2025 (narender)
