IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr. M. P. No. 121 of 2020 1. Prem Besra 2. Piyari Murmu @ Payari Beshra 3. Pormesal Besra @ Parmeshwar Besra 4. Bahamuni Murmu … Petitioners Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioners : Mr. Shashi Kant Thakur, Advocate For the State : Mrs. Srabani Sannyal, A. P. P. ------ Order No. 02 Dated- 05. 06. 2020 This criminal miscellaneous petition has been filed by the petitioners with a prayer for restoration of A. B. A. No. 8458 of 2019 to its original file. It is submitted by the learned counsel for the petitioners that on 06. 01. 2020, learned counsel for the petitioners was appearing in the mains examination of Assistant Public Prosecutor, hence, he could not appear before the court when A. B. A. No. 8458 of 2019 was called out resulting in the dismissal of the said anticipatory bail application.

It is next submitted that non-appearance of learned counsel for the petitioners on 06. 01. 2020 was neither deliberate nor intentional and the petitioners have very good grounds to agitate in A. B. A. No. 8458 of 2019 and unless the same is restored to its original file, the petitioners will be highly prejudiced. Hence, it is submitted that the A. B. A. No. 8458 of 2019 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioners, the prayer for restoration of A. B. A. No. 8458 of 2019 to its original file is allowed. Registry is directed to list A. B. A. No. 8458 of 2019 after a week before the appropriate Bench. This criminal miscellaneous petition is disposed of accordingly. (Anil Kumar Choudhary, J. ) Animesh/
