IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 7366 of 2024 ----- 1. Saket Kumar Gupta, S/o Dinanath Sao, Village Checharia, P. S. Nagar Untari, District Garhwa. 2. Shiv Kumar Oraon, S/o of Karam Uraon, Village Kamba Khurd, P. S. Nagar Untari, District Garhwa. .......... Petitioners. -Versus- The State of Jharkhand .......... Opp. Party. ----- CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioners : Mr. Sabyasanchi, Advocate For the State : Mrs. Kumari Rashmi, APP ----- Order No. 03 Date: 03. 12. 2024 1. The petitioners are apprehending their arrest in a case registered under Sections 272, 273, 290 & 34 of the Indian Penal Code; and Section 47(a) of the Excise Act. 2. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged. There is alleged recovery of 700 kg.
wet Jawa Mahua, kept in seven plastic drums, and 30 litres illegal country made Mahua liquor, kept in two plastic jars, from the mud house of the petitioner no. 2, situated in Kumbakhurd forest. It has further been alleged that both the petitioners were involved in manufacturing illegal Mahua liquor. In fact, there has been no such recovery from the house of the petitioner no. 2. False implication of the petitioners would be evident from the fact that the seizure list prepared in this regard does not bear signature of any independent witness. The petitioners have no criminal antecedent, as has been stated in paragraph no. 8 of the present anticipatory bail application. They, however, undertake to co-operate in ongoing investigation of the case. Hence, they may be given the privilege of anticipatory bail. 3. Learned A. P. P. opposes the petitioners’ prayer for anticipatory bail. 4.
Having heard learned counsel for the parties, this Court is inclined to enlarge the petitioners, above named, on anticipatory bail. Accordingly, the petitioners, in event of their arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand), each, with two sureties of the like amount, each, to the satisfaction of learned Additional Chief Judicial Magistrate, Nagar Untari, in connection with Nagar Untari P. S. Case no. 76 of 2024, subject to the condition as laid down under Section 482(2) of the B. N. S. S. , 2023. (Rajesh Shankar, J. ) Sanjay/ -2- A. B. A. No. 7366 of 2024
