Defects as pointed out by the office are ignored. The petitioner is apprehending his arrest in connection with Maheshpur P. S. Case No. 91 of 2019. It has been alleged that two tractors loaded with illegally extracted stone were intercepted and seized. It appears that one of the similarly situation co-accused namely, Dwarika Yadav @ Mahto has been granted anticipatory bail by this court in A. B. A. No. 4816 of 2019. The petitioner appears to be one of the drivers of the seized tractors.
Regard being had to the fact that similarly situated co-accused has been granted anticipatory bail by this court, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned C. J. M. , Pakur in connection with Maheshpur P. S. Case No. 91 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. This application stands allowed.
