HIGH COURT OF UTTARAKHAND AT NAINITAL First Bail Application No. 1940 of 2024 Kanhaiya Bhagat ….. …..... Applicant Versus State of Uttarakhand …. …. Respondent Present:- Mr. Vipul Sharma, Advocate for the applicant. Mr. Pramod Tiwari, Brief Holder for the State. Hon’ble Ravindra Maithani, J. (Oral) The applicant is in judicial custody in FIR/Case Crime No. 09 of 2024, dated 06. 03. 2024, under Sections 420, 467, 468, 120-B, 506 IPC, Police Station Thal, District Pithoragarh. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, the applicant and the co-accused enticed the informant to deliver them money so that they may ensure Government job to the daughter of the informant. 4. Learned counsel for the applicant would submit that the entire money has been returned by the applicant; the informant has been examined in the court; after that, they filed a compounding application which is pending disposal.
Reference has been made to the various documents. 5. It is also argued that in the instant case, the grounds of arrest has not been communicated to the applicant, which is violative of the constitutional provision and is a ground for bail. 6. Learned State counsel accepts the factual narrations with regard to the compounding application and payment having been made to the informant. 7. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
