For Respondent(s) : Mr. S. S. Rajpurohit, P. P. HON'BLE MR. JUSTICE MANOJ KUMAR GARG Judgment / Order 10/12/2020 The present misc. petition under Section 482 Cr. P. C. has been filed by the petitioner against the order dated 20. 11. 2020 passed by learned Additional Sessions Judge No. 05, Udaipur in Criminal Appeal No.
48/2019, whereby the learned Judge rejected the petitioner’s application for extension of time for furnishing the bail bond along with 20% of the Cheque amount as ordered by its order dated 21. 12. 2019 while suspending the sentence of the petitioner. Counsel for the petitioner submits that due to some unavoidable circumstances petitioner could not furnish the bail bond along with 20% of the Cheque amount as ordered by the (2 of 2) [CRLMP-4051/2020] appellate court within the stipulated period. Hence, time granted to the petitioner to deposit the aforesaid fine amount may be extended. Learned Public Prosecutor opposed the prayer made by the counsel for the petitioner. Having regard to the facts and circumstances of the case as well as in the interest of justice, this Court deems it appropriate to grant seven day’s time to the petitioner to comply with the order dated 21. 12. 2019 passed by the appellate court from today. The misc. petition stands disposed of accordingly.
Stay petition is also decided. (MANOJ KUMAR GARG),J 57-Prashant/-
