Jha, A. P. P. ---th Order No. 02 Dated 04 December, 2020 Heard the learned counsel for the respective sides. Defect No. 9(i), as pointed out by the office, is ignored. The petitioners apprehend their arrest in connection with Koderma P. S. Case No. 139 of 2020, pending before the Court of learned Chief Judicial Magistrate, Koderma. It has been alleged that on an information, a raid was conducted in the forest and 50 litres illegally distilled Mahua liquor was destroyed. Submission has been advanced that there is no specific allegation against the petitioners.
It has further been stated that merely on the disclosure of some persons inimical to the petitioners, their names have come up in the First Information Report. Learned APP has opposed the prayer for anticipatory bail of the petitioners. It appears that the petitioners are named in the First Information Report along with the other accused persons of fleeing away from the place of occurrence. Illicit liquor was also recovered from the said place and in view of the circumstances which has emerged, I am not inclined to extend the privilege of anticipatory bail to the petitioners.
