JUSTICE ARUN KUMAR JHA ORAL ORDER 4 22-12-2025 Heard learned counsel for the petitioner and learned APP for the State. 02. In the present case, the petitioner seeks bail in connection with Kanti P. S. Case No. 654 of 2024 registered for the alleged offences under Sections 191(2), 191(3), 190, 115(2), 126, 352, 351(3), 303(2) of B. N. S. and later on, Sections 109, 117(2)of B. N.
S. were also added. 03. As per prosecution case, the petitioner and other co-accused persons armed with lathi, danda abused the informant and her family members. This petitioner and co-accused Satahu Rai assaulted the husband of the informant with lathi on his head causing it fracture and also assaulted him with fists and slaps. The informant was also assaulted and her gold Patna High Court CR. MISC. No. 65305 of 2025(4) dt. 22-12-2025 2/3 mangalsutra was snatched. The gold Hanumani of the husband of the informant was also snatched. 04. Learned counsel for the petitioner submits that no occurrence as alleged in the manner took place. There was no intention to cause death. The allegation against the petitioner and co-accused is common. It is not clear who assaulted on the head of the husband of the informant.
The injury report shows lacerated wound on the mid of parietal region of size 1 1/4 x 1/4 x skin deep and swelling over right parietal frontal region apart from swelling over eye brow. The injuries are stated to be grievous but they are not dangerous to life and there was no repetition of blow. The occurrence took place in the background of some earlier dispute. The FIR has been lodged after much delay on 30. 12. 2024 whereas the occurrence took place on 18. 12. 2024 and fardbeyan was recorded on 22. 12. 2024. The parties are not only co-villagers but they are descendants of common ancestor. The petitioner is having clean antecedent. The petitioner is in custody since 02. 08. 2025 and charge sheet has been submitted. 05. Learned APP opposes the submission made on behalf of the petitioner. 06. Having regard to the facts and circumstances and Patna High Court CR. MISC. No. 65305 of 2025(4) dt.
22-12-2025 3/3 submissions made on behalf of the parties and considering the period of custody of the petitioner, his clean antecedent and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Muzaffarpur/concerned Court in connection with Kanti P. S. Case No. 654 of 2024, subject to the conditions mentioned in Section 480(3) of B. N. S. S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner. (ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
