GP THIS DEVASWOM BOARD APPLICATION HAVING BEEN FINALLY HEARD ON 19. 07. 2024, THE COURT ON THE SAME DAY DELIVERED THE FOLLOWING: D. B. A. No. 79 of 2004 ORDER Anil K. Narendran, J This DBA, along with the connected writ petition, i. e. , W. P. (C)No. 11620 of 2004, was disposed of by the judgment dated 29. 06. 2004. DBA No.
79 of 2004 was filed by the Travancore Devaswom Board seeking permission to undertake various works relating to Vaikom Sree Mahadeva Temple, which is under the management of Travancore Devaswom Board. The relief sought for in W. P. (C) No. 11620 of 2004 filed by the Kshethra Upadesaka Samithi of that temple was a writ of mandamus commanding the Travancore Devaswom Board to entrust the work of making new Thiruvabharanams to the Updesaka Samithi, at the same rate as has been granted in favour of Sree Krishna Metal Works and for other consequential reliefs. Paragraphs 2 and 3 of that judgment read thus; “2. We heard Sri Mohan. C. Menon for the petitioner and Sri. Gopakumaran Nair for the Travancore Devaswom Board and the learned Government pleader. All are agreed it is necessary to make the Thiruvabharanams and Aungy. So far as the making of Thiruvabharanams are concerned, the total cost is estimated at Rs. 1,23,550/-. The gold required is 3. 500 kgs.
The Board is ready to give the gold from the strong room. We direct the Board to make Thiruvabharanams with the 3. 500gms of gold obtained from strong room making the cost of Rs. 1,23,550/-. D. B. A. No. 79 of 2004 3. With regard to the other works, i. e. , providing bronze sculpture to the Sopanam, bronze covering to the Balikkallus, Valiya Balikkallu, namaskara Mandapam and brass sheet metal covering of Kodimaram Panchavargam are concerned, the Devaswom Board has estimated at a Cost Rs. 32,20,000/. So far as this matter is concerned, Kshethra Upadesaka Samithi has agreed to contribute Rs. 10 lakhs (Rupees ten lakhs only) within six weeks from today. The Board will start the work immediately on receipt of the amount. Since the Vaikathashtami is approaching in November, 2004, before that making of the Thiruvabharanams and covering of Balikkallus, Namaskara mandapam etc. be completed.
The Board will file progress report with regard to this matter in the last week of August, 2004, on 17. 08. 2004. ” 2. After the disposal of the DBA and the writ petition, the DBA was listed before the Bench on various occasions, for Adv. G. Sreekumar, the learned Advocate Commissioner to submit reports. Based on the reports of the learned Advocate Commissioner, this Court has issued various orders in the DBA and the last order was passed on 08. 10. 2007. 3. Today, when this matter is taken up for consideration, Sri. G. Santhoshkumar, the learned Standing Counsel for Travancore Devaswom Board, Sri. Mohan C. Menon, the learned counsel for the then Kshethra Upadeshaka Samiti of Vaikom Sree Mahadeva Temple and Sri. S. Rajmohan, the learned Senior D. B. A. No. 79 of 2004 Government Pleader would submit that the bronze covering of Balikkallus, Namaskara mandapams, etc. have already been completed based on the orders of this Court, and as such, no further orders are necessary in this DBA.
