JUSTICE RAHUL BHARTI, JUDGE JUDGMENT (ORAL) 01. This writ petition is disposed of at its inception stage keeping in consideration the fact that the petitioner No. 1 is a widow and respondent Nos.
2 and 3 are the daughters of contractor-Duni Chand, who died in a road traffic accident in 2019 and, at the time of his death, contractor-Duni Chand is said to have submitted a bill for payment with respect to the th construction work of “Semi Pacca R/wall in Km 6 RD(100-th 220) & Semi Pacca B/wall in Km 6 RD(75-220) of Jakyas Challer Road”, but before he could take the matter to its logical end in getting the release of the bill for the work done, fate intervened to take away his life, leaving the petitioners in a distressed state, and thereafter they came forward by taking up the matter with the Executive Engineer, PWD (R&B) Division Gandoh, Bhalessa by an application dated 11. 03. 2025, on which the Executive Engineer, PWD (R&B), Division Gandoh, Bhalessa called upon the Junior Engineer (JE) concerned to report. 02. The petitioners have also annexed a communication No. 779/SDK dated 08. 09.
2018 from the end of Assistant Executive Engineer (AEE), PWD (R&B), Sub-Division Kahara addressed to the Executive Engineer, PWD (R&B), Special Sub- Division Gandoh, Bhalessa related to the submission of bill of contractor-Duni Chand. 03. The petitioners have come forward with the institution of writ petition being purportedly aggrieved that the matter is not being considered at the end of the respondents. 04. Without any observation as to whether contractor- Duni Chand’s bill was pending clearance or it had been cleared, this Court is disposing of this petition with a direction to the Executive Engineer, PWD (R&B), Division Gandoh, Bhalessa to come up with the final order on the basis of the exercise set into effect in response to the application dated 11. 03. 2025 of the petitioner No. 1. 05.
Needful to be done at the end of the Executive Engineer, PWD (R&B), Division Gandoh, Bhalessa within a period of one month from the date of receipt of a certified copy of this order along with a copy of letter dated 11. 03. 2025 so submitted by the petitioner No. 1 to him. 06. The present writ petition is, accordingly, disposed of along with connected application.
