IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 6038 of 2020 --------- Sujit Kumar Khandelwal ... … Petitioner Versus 1. The State of Jharkhand 2. Ramdarshi Mahto @ Madan Mahto … Opposite Parties --------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY --------- For the Petitioner : Mr. Sanjay Kr. Singh, Advocate For the State : Mr. Vineet Kumar Vashistha, A. P. P. --------- 02/04. 12. 2020 Defects as pointed out by the office are ignored. Heard Mr. Sanjay Kr. Singh, learned counsel for the petitioner and Mr. Vineet Kumar Vashistha, learned A. P. P. for the State. The petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Complaint Case No. 2406 of 2018. Complainant and the accused were well acquainted with each other. It has been alleged that friendly loan of Rs. 1,00,000/- was given to the accused. However, the money was not returned.

Learned counsel for the petitioner submits that the complainant had some dues with the petitioner regarding purchase of paddy. It has further been stated that an undertaking was given to the complainant to return Rs. 3,00,000/- to the petitioner for which he has referred to a document. The nature of allegation reveals a civil dispute as it is with respect to non-returning of an amount of Rs. 1,00,000/- which was given to the petitioner as a friendly loan though the same has been denied by the petitioner by submitting that it is the complainant who was supposed to return a huge amount to the petitioner for which an undertaking was also executed by the complainant. On consideration of the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Therefore, the petitioner, named above, is directed to surrender in the court below within a period of four weeks from today and on such surrender, he shall be released on bail on furnishing -2-bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned st Judicial Magistrate, 1 Class, Hazaribag in connection with Complaint Case No. 2406 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands allowed. (Rongon Mukhopadhyay, J. ) Umesh/-
