Sr. No. 43 HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU Case : CPSW No. 335/2014 in CPSW No. 418/2013 Jagattar Singh …Petitioner(s)/Appellant(s) Through: None. V/s Pawan Kotwal and others ... Respondent(s) Through: Ms. Saliqa Sheikh, Assisting counsel to Mr. Raman Sharma, AAG. CORAM: HON’BLE THE CHIEF JUSTICE ORDER 19. 12. 2025 The petitioner prays for initiation of contempt proceedings against the respondents for willful defiance of Judgments dated October 30, 2013 and May 09, 2013 passed by the Writ Court in SWP No. 1044/2013 & COA(S) No. 418/2013 (Jagattar Singh Vs. State of J&K & Ors). The petition, preferred by the petitioner, was disposed of by the Writ Court on May 09, 2013 with a direction to the respondents to consider his claim strictly in accordance with rules and having regard to the Judgment dated December 21, 2011 passed by this Court in SWP No. 785/2009.
Further, the Collector Land Acquisition, Jammu was also directed to consider and assess the compensation of the subject land within a specified time. For, the directions contained in the said order was not complied with, the petitioner was impelled to file COA(S) No. 418/2013, which too was disposed of vide order dated October 30, 2013, with a direction to the respondents to ensure compliance expeditiously and not later than two months. CPSW No. 335/2014 Page 1 of 2 It appears, for, despite the orders passed by this Court, the matter made no tangible progress, the petitioner again approached this Court vide the petition at hand. Learned counsel for the respondents, at the outset, has drawn attention of the Court to the compliance report submitted on behalf of the respondents.
And, with reference to the averments set out in Para 3 thereof, submits that in compliance to the order passed by this Court, the claim of the petitioner was thoroughly examined and found devoid of merit and was not covered under the rules. She submits that the formal order of rejection passed in this regard on September 22, 2014 is appended as Annexure-R1. That being so, nothing substantive survives in the petition and the same is disposed of as having been rendered infructuous.
