RAJAWAT - ADVOCATE This application coming on for admission this day, the court passed the following: ORDER Applicants have filed this first application under Section 439 of Cr. P. C.
Applicants have been arrested on 26/12/2023 by Police Station Raghogarh, District Guna in connection with crime No. 281/2023 dated 5/6/2023 registered for offence under Sections 279, 337, 294, 323, 506, 34, 307, 120-B of IPC. It is the submission of learned counsel for the applicants that applicants have been falsely implicated in the matter due to political rivalry. Initially an FIR was registered on behalf of applicants' side which was registered vide Crime No. 455/2022 by same police station and in counter-blast this false case has been got registered. Initially the FIR was not registered for offence under Section 307 of IPC; however, complainant side being politically influenced persons, the offence under Section 307 IPC has been registered later on. Applicants No. 1 and 2 are agriculturist and applicant No. 3 is a student. On these grounds, prayer for bail is made out.
On the other hand, learned counsel for the State as well as complainant opposed the prayer and prayed for dismissal of the application. Considering the overall facts and circumstances of the case, without commenting on the merits of the case, application is allowed and it is directed that on furnishing personal bond in the sum of Rs. 1,00,000/- each (Rs. One Lac each only) with two solvent sureties of like amount, the applicants shall be released on bail to the satisfaction of the trial Court. This order will remain operative subject to compliance of the following conditions by the applicants :- 1. The applicants will comply with all the terms and conditions of the bond executed by them; 2. The applicants will cooperate in the investigation/trial, as the case may be; 3.
The applicant will not indulge themselves in extending inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to the Police Officer, as the case may be; 4. The applicants shall not commit an offence similar to the offence of which they are accused; 5. The applicants will not be a source of embarrassment or harassment to the complainant party in any manner and applicants will not seek unnecessary adjournments during the trial; 6. The applicants will not leave India without previous permission of the trial Court/Investigating Officer, as the case may be; 7. Applicants shall not be the source of embarrassment and harassment to the complainant party in any manner and shall not try to tamper with the evidence in any manner. they shall regularly appear before the trial Court. Application stands allowed and disposed of. Certified copy as per rules.
