HASSANTUK, P. S. RANGIA, DIST. KAMRUP, ASSAM. VERSUS 1:THE STATE OF ASSAM AND ANR REPRESENTED BY PP, ASSAM. 2:KURBAN ALI S/O LT. ABDUL RAHMAN SK. VILL. KATLAMARI P. S. DAKHIN SALMARA DIST. DHUBRI Advocate for the Petitioner : MR. K KALITA Advocate for the Respondent : PP, ASSAM BEFORE HONOURABLE MR. JUSTICE SUMAN SHYAM HONOURABLE MR. JUSTICE HITESH KUMAR SARMA ORDER 18-06-2020 (Suman Shyam, J) Heard Mr. K. Kalita, learned counsel for the applicant-appellant. Also heard Ms. B. Bhuyan, learned Additional Public Prosecutor, appearing for the State. The applicant has assailed the judgement and order dated 30-07-2014, passed by the learned Sessions Judge, Amingaon, in connection with Sessions Case No. 258(KA) of 2014 by Page No. # 2/2 preferring the criminal appeal No.
181 of 2016, which is pending disposal before this Court. It appears that in the memorandum of appeal, the name of the appellant has been erroneously mentioned as ‘Rahman Ali’ whereas, his correct name is ‘Raham Ali’. This interlocutory application has, therefore, been filed with a prayer to permit correction in the cause title by correcting the name of the appellant-applicant as ‘Raham Ali’ instead of ‘Rahman Ali’. We find from the record that there is an error in the spelling of the name of the appellant in the memorandum of appeal. The prayer made in the interlocutory application is also not contested by the learned Additional Public Prosecutor. As such, we are inclined to allow the prayer. Registry to rectify the name of the appellant in the memorandum of appeal and insert his name as ‘Raham Ali’ instead of ‘Rahman Ali’. With the above observation this interlocutory application stands disposed of. JUDGE JUDGE Comparing Assistant
