JUSTICE BALJINDER SINGH SANDHU Order 06/08/2026 Heard learned counsel for the parties, and perused the material available on record. The petitioners have been arrested in connection with FIR No.
187/2026 of Police Station Srivijaynagar, District Ganganagar, for the offences punishable under Sections 8/21 and 29 of NDPS Act. They have preferred this bail application under Section 483 of BNSS. Learned counsel for the petitioners submits that the alleged contraband, namely 40 grams of heroin, was recovered from petitioner No. 1, Harpreet. It is further submitted that the said [2026:RJ-JP:37496] (2 of 3) [CRLMB-10232/2026] contraband was allegedly purchased from petitioner No. 2, Baljinder Singh @ Binda. The recovered quantity is below the commercial quantity. It is also submitted that the petitioners have no criminal antecedents under the NDPS Act. The petitioners have been in judicial custody since the date of their arrest, and the trial is likely to take a considerable time to conclude. Per contra, learned Public Prosecutor has vehemently opposed the bail application.
This Court has considered the arguments advanced by learned counsel for the petitioners and finds that the alleged contraband, namely 40 grams of heroin, was recovered from petitioner No. 1, Harpreet. It is alleged that the said contraband was purchased from petitioner No. 2, Baljinder Singh @ Binda. The recovered quantity is below the commercial quantity. Further, the petitioners have no criminal antecedents under the NDPS Act and have been in judicial custody since the date of their arrest. Hence, keeping in view of the fact that conclusion of the trial of the case is likely to take time. The recovered contraband is below commercial quantity and the prosecution has not shown any apprehension of the petitioners fleeing away from justice, in case they are enlarged on bail and without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the petitioners under Section 483 of BNSS.
Accordingly, this bail application filed under Section 483 of BNSS is allowed and it is directed that petitioners – Harpreet Singh S/o Gurdev Singh and Baljinder Singh @ Binda, shall be released on bail in connection with aforesaid FIR, if not wanted [2026:RJ-JP:37496] (3 of 3) [CRLMB-10232/2026] in any other case, provided they execute a personal bond in the sum of Rs. 1,00,000/- with two sound and solvent sureties of Rs. 50,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
