P. ---th Order No. 02 Dated 07 December, 2020 Heard the learned counsel for the respective sides. The defect No. 9(i), as pointed out by the office, is ignored. The petitioner apprehends his arrest in connection with Meral P. S. Case No. 105 of 2020. When the informant and his son were returning on a motorcycle from work, a motorcycle had dashed against them and both fell on the ground. The son of the informant later on succumbed to his injuries. The petitioner appears to be driver of the offending motorcycle and it appears that there was no intention on the part of the petitioner to dash against the motorcycle of the informant.
The matter appears to have been compromised between both the sides. On consideration of the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner. The petitioner is accordingly directed to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Garhwa in connection with Meral P. S. Case No. 105 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands disposed of. MK (RONGON MUKHOPADHYAY,J. )
