PETITIONER (BY SHRI YASH SHARMA- ADVOCATE ) AND 1. SHRI RAJESH SINGH CHANDEL SUPERINTENDENT OF POLICE (RAIL) GWALIOR (MADHYA PRADESH) 2. SHRI ALOK SINGH BHADORIYA STATION HOUSE OFFICER MAHARJPURA, GWALIOR (MADHYA PRADESH) ..... RESPONDENTS (NONE) This petition coming on for admission this day, th e court passed the following: ORDER The present contempt petition has been filed against the non-compliance of the directions passed by this Court in Criminal Case No. 21876/2022 dated 12. 05.

2022, whereby the investigating officer was directed to conclude the investigation as early as possible and to take necessary steps as required under the law with a further direction that if grievance still persists, then the applicant is free to make an application to the Superintendent of Police, Gwalior which Signature Not Verified Signed by: CHANDNI Signing time: 05-Jan-24 11:39:39 AM shall be looked into in accordance with law. The contention of the petitioner is that even after moving of the application before the concerned investigating officer in the month of December, 2022, since more than a year has been passed the investigation has not been concluded nor any further steps had been taken. A similar application was then moved to the Superintendent of Police, but till date no action has been taken. Thus, the police authorities had flouted the orders passed by this Court and, therefore, they are liable to be held in contempt of court.

After going through the impugned order, this Court finds that the directions to the investigating officer is to conclude investigation as early as possible and take necessary steps as required under the law and if any grievance still persists, then the applicant is free to make an application to the Superintendent of police, Gwalior, no any directions of concluding the investigation within a time bound frame was issued. Thus, according to this court no contempt is made out, however, this Court deems it expedient to direct Superintendent of Police to look into the matter and issue necessary directions to the investigating officer. With the aforesaid direction, the contempt petition stands disposed of. CC as per rules/directions.
