This appeal is directed against the order dated 09. 06. 2020, passed by learned Additional Sessions Judge- I, Gumla, whereby the prayer for bail of the appellant has been rejected in connection with SC/ST (Gumla) P. S. Case No. 04 of 2020 registered under Sections 147, 148 149, 341, 323, 324, 325, 307, 307 342 of the Indian Penal Code and Section 3(2)(i) (v) of SC/ST (Prevention of Atrocities) Act, 1989. 2. Heard the learned counsel for the appellant and learned P. P.
On perusal of the case diary it appears that there is allegation that the appellant had posted video footage on whatapps leading to clash between two communities consequent thereto, one person died in the clash. The origin of the post was traced to the mobile of the appellant. There is no allegation that the appellant had participated in the fight and assaulted the deceased. In view of the materials on record, the appellant is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand only) with two sureties of like amount each to the satisfaction of the learned Additional Sessions Judge-I, Gumla, in connection with SC/ST (Gumla) P. S. Case No. 04 of 2020. 3. With the aforesaid direction, the appeal is, hereby, allowed. (AMITAV K. GUPTA, J. ) Tarun/
