Pradeep Kumar, son of Late Ramkeshwar Prajapati, resident of Plot No. 50, Co-operative Colony, P. O. & P. S. - B. S. City, District- Bokaro …. … Opposite Parties CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR For the Petitioner : Mr. Baibhaw Gahlaut, Advocate For the State : Mr. Anchinto Sen, A. P. P. For the O. P. No. 2 : Mr. Subhneet Jha, Advocate Order No. 04 Dated: 11. 12. 2024 The petitioner apprehending his arrest for the offences punishable under Sections 341/323/325/307/379/34 of the Indian Penal Code, has prayed for grant of anticipatory bail. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F. I. R.
It is further submitted that pursuant to lodging of the F. I. R. , the petitioner and the opposite party no. 2 entered into a compromise and a joint compromise petition was also filed by them in the court of learned Principal District & Sessions Judge, Bokaro while consideration of A. B. A. No. 715 of 2024 preferred by the petitioner. A copy of the said joint compromise petition has been annexed as Annexure-2 to the present anticipatory bail application. It is further submitted that though the offence under Section 307 of the I. P. C. is not compoundable, yet considering the compromise entered with the opposite party no. 2, the petitioner may at least be granted anticipatory bail. 3. Learned counsel for the opposite party no. 2 accepts the fact that the present dispute between the petitioner and the opposite party no. 2 has been compromised.
He also submits that a copy of joint compromise petition, annexed as Annexure-2 to the present anticipatory bail application, is a genuine one and the opposite party no. 2 has no objection if the petitioner is granted privilege of anticipatory bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail. 5. Accordingly, the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like st amount each to the satisfaction of learned Judicial Magistrate-1 Class, Bokaro in connection with B.
