HIGH COURT OF TRIPURA AGARTALA AB 4/2020 Rossan Khadem ----Petitioner(s) Versus The State of Tripura ----Respondent(s) For Petitioner(s) : Mr. D. Datta, Advocate For Respondent(s) : Mr. Ratan Datta, PP HON’BLE MR. JUSTICE ARINDAM LODH Order 14/01/2020 Heard Mr. D. Datta, learned counsel appearing for the accused-petitioner as well as Mr. Ratan Datta, learned PP appearing for the State-respondent. This is an application filed under section 438 Cr. P. C. for granting pre-arrest bail to the accused-petitioner who is wanted in connection with PR Bari PS case No. 79 of 2019 under Sections 20(b)(ii)(B)/29 of the NDPS Act. I have perused the case diary as produced by the learned Public Prosecutor. After perusal of the case diary, it appears that there was some conspiracy for implicating the petitioner in connection with the instant case. Moreover, the provision of the NDPS Act is prima facie found to be misused. Hence, I am inclined to release the accused-petitioner on pre-arrest bail.
Accordingly, it is ordered that in the event of arrest, the accused-petitioner, namely, Rossan Khadem, shall be released on pre-arrest bail, on furnishing a bail bond of Rs. 50,000/- with one surety of the like amount to the satisfaction of the Arresting Authority. However, the accused-petitioner shall appear before the investigating officer by tomorrow (15. 01. 2020) and shall co-operate and assist the process of investigation in all respects and also shall appear before the concerned police station as per direction of the investigating officer. With the above direction, the instant application stands allowed and thus disposed of. Return back the case diary JUDGE Saikat
