Respondent/ Complainant ORDER This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS) by a the petitioner/accused seeking enlargement on bail in connection vvith Crime No. O7 of 2025 of Cyberabad Narcotics Police Station, Telanganrr Anti Narcotics Bureau (TGANB). The \ I , -r* . i, -. - r \': r-') sKs,J Crl. P. I{o. 15731 of 2O25 \ offences alleged against the petitioner are under Sections 8(c) read with 2O(b)(iiXCl, 27A and,29 of the NDPS Act and Secrion 25(1-B)(b) of Arms Act, 1959. 2. The brief facts of the case are that, based on credible information, on 04-OB-2025, the police conducted vehicle checking and found accused Nos. 1 and 2 in possession of huge quantity i. e. , 847 kilograms of ganja.

Consequently, a case was registered against the petitioner*s and other accused for the above mentioned offences. 3. Heard Sri Reddamaina Thirupathi, learned counsel appearing on behalf of the petitioners as well as Sri Arun Kumar Doddle, learnecl Additional Public Prosecutor appearing for respondent - State. 4. Learned counsel for the petitioners submitted that accused No. l is a driver and accused No. 2 is a cleaner of the I alleged vehicle and have been in jail since 05. 08. 2025 and that that petitioners are innocent and have no connection whatsoever with the offences in question, as the contraband was not in their conscious possession and that the material part of investigation is completed. Therefore, he prayed the Court to grant bail to the petitioners by allouring this criminal petition. I I l sxs,J Crl. P. [o. 15731 of 2(),15 5.

On the other hand, the learned Additional public Prosecutor opposed the submissions made by the learned counsel for the petitioners, stating that the contraband involved in this case, namely 847 kilograms of ganja, constitutes a huge quantity. He further submitted that accused No. t had previously been involved in three crimes under the NDpS Act and is a habitual offender and that the investigation is still in progress and that, if the petitioners are released on bail at this stage, they may tamper with the evidence and threaten the t witnesses. Hence, he prayed the Court to dismiss tJ.. e criminal I petition. 6. Having regard to the rival submissions made by both the learned counsel and upon perusal of the material placed on record, it is noted that the petitioners are arrayed as accused Nos. l and 2 and have been in judicial custody since 05. 08. 2025. The seized contraband, i. e.

, 842 kilograms of ganja, constitutes a huge quantity, a and there exists a previous criminal history against accused No. l. The investigation is still in progress. In view of Section 37 of the NDpS Act, offences involving commercial quantities are non-bailable and require reasonable grounds to believe that the accused are not guil$r and are unlikely to commit further offences while on bail. Given sKs'. , a Crl. ero. 1573l ol2025 the serious allegations against the petitioners, this Court is not satisfied that the conditions for granting bail under Section 37 of the NDPS Act are met. Therefore, the criminal petition lacks merit and the same is liable to be dismissed. 7. Accordingly, this Criminal Petition is dismissed.
