IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 4975 of 2020 --------- 1. Irshad Ansari 2. Nirmal Kumar Singh @ Nirmal Singh 3. Samim Anwar ... … Petitioners Versus The State of Jharkhand ... … Opposite Party --------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY --------- For the Petitioners : Mr. Sheo Kumar Singh, Advocate For the State : A. P. P. --------- 02/16. 12. 2020 Defects as pointed out by the office are ignored. Heard Mr. Sheo Kumar Singh, learned counsel for the petitioners and learned A. P. P. for the State. The petitioners have prayed for grant of anticipatory bail, as they are apprehending their arrest in connection with Patratu P. S. Case No. 104 of 2020. Some vehicles involved in illegal mining of sand were intercepted. The petitioner no. 1 is the owner of the vehicle bearing Registration No. JH 02L 1873. The petitioner no. 2 is the driver of the said vehicle while the petitioner no. 3 is the owner of the vehicle bearing Registration No. JH01CH 4527.

So far as the petitioner no. 2 is concerned, he was the driver of the vehicle who had fled away from the place of occurrence and in such circumstance, therefore, I am not inclined to extend the privilege of anticipatory bail to the petitioner no. 2. The prayer for anticipatory bail of the petitioner no. 2 is, hereby, rejected. However, so far as the petitioner nos. 1 and 3 are concerned, it has been submitted that the vehicles in question were entrusted to the driver and, therefore, being the owners they cannot be hauled up for being involved in the commission of the offence and that one of the co-accused namely Om Prakash Yadav has already been granted anticipatory bail by this Court in A. B. A. No. 4986 of 2020. On consideration of the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner nos. 1 and 3. Therefore, the petitioner nos.

1 and 3, named above, are directed to surrender in the court below within a period of four weeks from today and on such surrender, they shall be released -2-on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Ramgarh in connection with Patratu P. S. Case No. 104 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands disposed of. (Rongon Mukhopadhyay, J. ) Umesh/-
