IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 4218 of 2020 Amar Kumar Das ... Petitioner Vs. 1. The State of Jharkhand 2. Sangita Devi .... Opposite Parties --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY Through Video Conferencing --- For the Petitioner : Mr. Rishu Ranjan, Advocate For the State : Mr. Tapas Roy, A. P. P. ---th Order No. 02 Dated 15 December, 2020 Heard the learned counsel for the respective sides. The defects, as pointed out by the office, are ignored. The petitioner apprehends his arrest in connection with Complaint Case No. 453 of 2018. The petitioner who is the husband of the complainant had lodged an F. I. R. regarding the complainant becoming traceless. The complainant was recovered and in her 164 Cr. P. C. statement she admitted to be having a love affair with one Ganesh. The complainant appears to have filed a suit for dissolution of the marriage with the present petitioner. In the 164 Cr. P. C.
statement of the complainant in the case which was instituted by the petitioner she has stated that she was having a love affair with one Ganesh with whom she had solemnized marriage. So far as the allegations in the present case is concerned, it appears that the marriage of the complainant was solemnized with the petitioner in the year 2013. There was a demand of Rs. 1 Lakh and on non-fulfillment of which she was tortured and ultimately she was ousted from her matrimonial home on 05. 08. 2018. However, the allegation seems to have been diluted in view of the 164 Cr. P. C. statement of the complainant in the case instituted by the petitioner in which she has admitted to have solemnized marriage with one Ganesh. On consideration of the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioner.
The petitioner is accordingly directed to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties 2. of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Ramgarh in connection with Complaint Case No. 453 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This application stands allowed. MK (RONGON MUKHOPADHYAY,J. )
