The present habeas corpus petition has been instituted seeking a direction to the respondents to release Mr. Lunminthang Haokip, aged about 33 years, a permanent of resident of Kholmun Village, P. O. , P. S. and District Churachandpur, Manipur, in terms of the order dated 07. 11. 2023 passed by the Ld. Special Judge (ND & PS), Senapati directing his release in connection with FIR No.
17(05) 2022 KPI-PS U/s 21 (C) 29/60(3) ND & PS Act. Pursuant to the direction issued by this Court dated 16. 04. 2024, a communication No. SJ(ND & PS)/SPT/2024/260, dated 18. 04. 2024 has been received from the Office of the Special Judge, (ND & PS), Senapati, clearly and unequivocally stating that there is an order directing release of Mr. Lunminthang Haokip in connection with the said subject FIR and consequential order dated 07. 11. 2023. In view of the foregoing, Mr. M. Devananda, learned Additional Advocate General, Manipur appearing on behalf of the State of Manipur states that Mr. Lunminthang Haokip shall be released forthwith. Kom, learned counsel appearing on behalf of the petitioner, however, seeks liberty to approach the State of Manipur for protection in accordance with law during the course of the day.
